  1. About Diagnostic Imaging Pathways

1.1 This website (Website) is owned and operated by Radiology Across Borders Limited ACN 164 736 850 (RAB).

1.2 A "User" means a person who accesses the Website for any purpose. Each User of the Website will agree and comply with the following terms and conditions of use (Terms).

1.3 These Terms, as amended and varied from time to time, apply to your use of the Website and form a contract between you and RAB.

1.4 By using the Website in any manner, you agree and accept the Terms and the RAB Privacy Policy. If you do not accept these Terms, you must refrain from using the Website.

1.5 RAB reserves the right, in its absolute discretion, at any time and without notice to amend, remove or vary the Terms and/or any page of the Website.

2. Risk and Liability

2.1 You acknowledge that the information and materials published on the Website (Content) are provided voluntarily and are for information purposes only.

2.2 RAB and its officers, employees and agents (each, a Relevant Person) make no representation or warranty as to the accuracy, reliability, completeness, suitability or currency of the Content on the Website or the content on other websites which are linked to the Website (Linked Site).

2.3 The Content is subject to, and is to be utilised in the context of, continuing research and clinical experience.

2.4To the maximum extent permitted by law, RAB and each Relevant Person:

2.4.1 exclude all express or implied warranties of any kind in relation to the Content or the content on any Linked Site;

2.4.2 are under no obligation to update any information on the Website or correct any inaccuracy which may become apparent at a later time;

2.4.3 reserve the right, in their absolute discretion, to delete, alter or move any Content on or from the Website (including these Terms) at any time without notice;

2.4.4 disclaim all liability (including but not limited to liability for negligence) to any person for any direct or indirect loss (including any expenses or costs) arising out of:

2.4.4.1 any act or failure to act by any person in accessing, using or relying on any information contained on the Website or any Linked Site;

2.4.4.2 any errors, misstatements, unauthorised amendments or omissions on the Website or any Linked Site; and

2.4.4.3 any delay or interruption in access to, or use of, the Website or any Linked Site.

2.5 You acknowledge that the Content includes guidelines, opinions, conclusions, recommendations and other information. It comprises general medical information only and has not been prepared taking into account a person's specific medical condition or personal circumstance.

2.6 The Content should be regarded only as a guideline. A User should not act or fail to act on the basis of any of the Content. The Content is provided solely on the basis that each User will be responsible for making their own assessment of the matters discussed and presented herein and are advised to verify all relevant representations, statements and information.

2.7 The Content is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Each User should always seek advice from qualified health professionals to clarify or confirm the Content.

3. Intellectual Property Rights

3.1 All images, trademarks, logos, text, graphics and other intellectual property appearing on the Website is the property of RAB (or is used by RAB under licence). The use of RAB's intellectual property is strictly prohibited unless RAB provides prior written consent.

3.2 This Website or any portion of the Website or the Content, may not be reproduced, duplicated, copied, sold, or otherwise exploited for any purpose except where necessary for viewing the Website on your internet browser, or where specifically authorised by law or in writing by RAB.

4. Linked Site

4.1 The Website may contain links to other websites, content or resources which are owned or operated by third parties.

4.2 Each Linked Site is not under RAB's control and RAB and each Relevant Person is not responsible for the operation, availability or content of any Linked Site or any link contained in a Linked Site.

4.3 The inclusion of any Linked Site does not imply RAB's endorsement or approval of such third parties, their websites or their businesses or other activities.

4.4 Subject to any non-excludable rights, each of RAB and each Relevant Person does not warrant the accuracy, reliability, completeness or currency of any Linked Site, nor the suitability of the content of any Linked Site.

4.5 Use, access or reliance on a Linked Site is at each User's risk. Links to any Linked Site are for convenience only.

5. Malware and Security

5.1 RAB and each Relevant Person does not represent or warrant that any material obtained from or through the Website or a Linked Site will be free from computer viruses or other defects. RAB and each Relevant Person does not accept any liability for the presence of computer viruses or other defects.

6. Privacy Policy Statement

6.1 For the purposes of gathering information about utilisation or impact of the Website, or gathering feedback from a User to guide improvements, RAB may utilise electronic or hard copy questionnaires or surveys (Instruments). Information obtained via Instruments, including personal information such as names, telephone numbers, and e-mail addresses of any User, may be stored on databases by RAB.

6.2 A User will only be contacted by RAB regarding an Instrument if prior consent has been given by the User. Any personal information will be managed according to the Privacy Act 1988 (Cth) and any other privacy laws applicable to RAB.

6.3 The image galleries on the Website contain examples of various clinical conditions. All images in the image galleries have been altered to remove direct identifiers or personal information to prevent re-identification (De-Identified Image).

6.4 Each De-Identified Image is assessed contextually, taking into consideration the environment the De-Identified Image will be released into (i.e. the Website), including the risk of re-identification. A De-Identified Image will only be uploaded to the Website if there is no reasonable likelihood of re-identification. Records of any personal patient data removed from the images are not stored by RAB.

6.5 RAB's Privacy Policy.

7. Cookies

7.1 RAB may use “cookies”. A cookie is a small file that stays on your computer until, depending on whether it is a sessional or persistent cookie, you turn your computer off or it expires. Cookies may collect and store your personal information. You may adjust your internet browser to disable cookies. If cookies are disabled you may still use the Website, but the Website may be limited in the use of some of the features.

8. Use by Third Parties

8.1 RAB may contact individuals and entities (Third Parties) to evaluate the impact of the use of the Website on clinical practice. Information may be gathered on clinical practices and their patients during this process but all information is de-identified.

9. General Conditions

9.1 The Terms are governed by and interpreted in accordance with the laws of New South Wales, Australia and you irrevocably submit to the non-exclusive jurisdiction of the Courts of New South Wales, Australia. If any provision of these Terms is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of this policy, which will continue in full force and effect.

9.2 f you access the Website in a jurisdiction other than New South Wales, Australia, you are responsible for compliance with the laws of that jurisdiction, to the extent that they apply. RAB makes no representation that the Content complies with the laws of any country outside Australia.

9.3 If any part of the Terms is found to be void, invalid, unlawful or unenforceable then that provision or part will be deemed to be severed from the Terms and the remaining Terms will remain in force and constitute the agreement between the User and RAB.
